Contract of Public Offer for purchases in online-store www.shop.comeforta.by
- GENERAL STATEMENTS
- This contract shall determine the conditions for retail sale provided by the Seller via the online-store in accordance with Article 405 of the Civil Code of the Republic of Belarus (further CC of the Republic of Belarus). It is a public offer of the Seller that is addressed to one or more specific person who may be both resident and non-resident of the Republic of Belarus.
- The relations between the Seller and the Buyer (further – the Parties) shall be regulated by the statements of Paragraph 2, Article 30 of CC of the Republic of Belarus (Retail sales) as well as by the Act “On Trade” of the Republic of Belarus, the Consumer Protection Act, the Decision of the Council of Ministers “On approval of the Rules of retail sales according to the samples” and other normative acts and regulations on retail sales.
- Making an order through the on-line store means that the Buyer agrees with the terms of the present Contract of a Public Offer. A natural person who confirms the acceptance of this Public Offer shall become the Buyer in case he/she agrees with the terms of the present Contract. The payment for goods shall be considered as the acceptance of the Offer according to the terms of the Contract, which amounts to the conclusion of the Contract on the terms specified in the Offer (Paragraph 3, Article 408 of CC of the Republic of Belarus).
- In the view of the foregoing, please, study the text of this Public Offer carefully. In case you do not agree with any clause in the Offer, you may decline your purchase or refuse the service provided by the Seller.
- The administration of the online-store shall have the right to change the Offer without any notice to the Buyer.
- The Offer shall be of unlimited duration, unless otherwise specified on the web-site of the online-store.
- The Seller shall provide the Buyer with full and reliable information on goods including the information on the basic consumer properties, location of manufacturing activities, guarantee period and useful life of the product. Such information shall be presented on the web-site of the online-store under “Catalogue”.
- DEFINITION OF TERMS
- A Public offer (further – the Offer) is a Seller’s public offer to conclude the contract of sale (further – the Contract) remotely and on the terms specified in this Offer including all of its annexes, which is addressed to one or more specific persons,
- An order on the web-site of the on-line store shall be considered as the items chosen from the range of goods by the Buyer when making an order for purchase on the web-site or through the operator.
- The Seller is LLC “VentMcom” that shall dispose the goods presented on the web-site shop.comeforta.by.
- The Buyer is a person who has concluded a contract with the Seller on the terms specified in it.
- Acceptance is full and unconditional acceptance of the terms of the Contract by the Buyer.
- Goods are the variety of assortment names presented in the web-site by the online-store.
- Delivery implies courier services in delivering of an order.
- Payment is the fact of receiving money for the order onto our account.
- PURCHASE PRICE
- The price of each product shall be specified on the web-site shop.comeforta.by of the online-store.
- The Seller shall be unilaterally entitled to change the price of any position.
- In the event of price changes of the ordered goods, the Seller shall inform the Buyer about the changes of the price within a day.
- The Buyer shall be entitled to confirm or cancel his/her order for a product in case the price has been changed by the Seller after the order was placed.
- The price changes for the paid goods may not be allowed.
- The Seller shall specify delivery charges on the web-site of the online-store or inform the Buyer when placing the order.
- The Buyer’s payment obligations shall be treated as performed since money have been credited to the Seller’s account.
- The payment may be carried out in any way specified on the web-site of the online-store under “Payment and Delivery”.
- PROCESS OF ORDERING
- The Buyer may make an order through the Operator by phone numbers specified on the main page of the online-store or via the service shop.comeforta.by .
- When registrating on the web-site of the online-store the Buyer shall undertake to provide the following registration information:
- Last name, first name, patronymic name of the Buyer or the person concerned (consignee).
- The address to which the goods shall be sent (if delivery shall be made to the address of the Buyer).
- The e-mail address.
- The contact number.
- The name, quantity, assortment, set number, price of the chosen goods shall be specified in the Buyer’s shipping cart on the web-site of the online-store.
- If the Seller needs any additional information, he/she shall be entitled to request it from the Buyer. In case the requested information is not provided by the Buyer, the Seller shall not take any responsibility for the goods chosen by the Buyer.
- The Buyer shall undertake to provide the information specified in article 4.2 of the present Offer if his/her order is made through the Operator (article 4.1 of the present Offer).
- The acceptance of the conditions of the present Offer by the Buyer shall be carried out by entering the appropriate data into the registration form on the web-site of the on-line store as well as when making an order through the Operator. After making an order through the Operator the Buyer’s data shall be registered in the Seller’s data base. While confirming his/her order, the Buyer gives the Operator all required information in accordance to the procedure specified in article 4.2. of the present Offer.
- The Seller shall not take any responsibility for the content and reliability of information provided by the Buyer when making his/her order.
- DELIVERY AND HANDING OVER GOODS TO THE BUYER
- The Seller shall provide delivery services to the Buyer in one of the ways specified on the web-site of the online –store under “Payment and Delivery”.
- If the Contract of sale is concluded remotely on the terms of delivery to the Buyer, the Seller shall deliver the product to the place designated by the Buyer on time. If the place is not specified, the delivery shall be carried out at addressee’s residence or registration.
- The Buyer shall specify the place of delivery when making his/her order.
- The time of delivery shall depend on availability of the ordered items on the Seller’s warehouse as well as on the time required for order processing. In exceptional cases, the lead time may be agreed with the Buyer individually depending on the type and quantity of the ordered goods. In case there is not any part of the order on the warehouse, including the cases when it’s due to the reasons beyond the Seller’s control, the Seller shall possess the right to cancel this item from the Buyer’s order. The Seller shall undertake to inform the Buyer on the changes in his/her order completeness.
- The delivered product shall be handed over to the Buyer. In case of the Buyer’s absence, it may be handed over to any person who may provide the receipt for payment or any other document confirming that the Contract has been concluded or delivery has been processed.
- The information on the goods shall be presented in the technical documentation annexed to the goods as well as on the labels by affixing marking or in any other way adopted for some product varieties.
- MONEY-BACK AND GOOD RETURNING
- The quality and completeness of the goods shall comply with the requirements of the existing technical regulatory and legal acts of the producer.
- The Seller shall hand over the goods to the Buyer that are fully corresponding to his/her order. The quality of the product shall comply with the information provided to the Buyer when concluding the Contract as well as with the information provided when handing over the goods (on the label, inserts or package as well as in any other envisaged way).
- When receiving the goods, the Buyer shall ensure that the goods have been delivered undamaged and in entire package, with the labels (inserts).
- The Buyer shall check the accordance of the delivered goods with the placed order.
- When purchasing a product in the online store, the Buyer retains all his/her rights guaranteed by the Consumer Protection Act of the Republic of Belarus.
- The Buyer shall have the right to require substituting the goods of inferior quality for the goods of appropriate quality if the defects have not been specified by the Seller.
- The substitution of the goods shall be carried out in a commercial store for order receiving within 14 calendar days regardless the time for delivery if the Seller has such goods available. The return of the goods shall be carried out by the Buyer him/her-self as well as at his/her own expense.
- The Seller shall handle the adjudication of claims as well as the returning of money to the Buyer in accordance with the legislation of the Republic of Belarus.
- GUARANTEE AND RESPONSIBILITY
- In case of failure to execute or inappropriate execution of the obligations under the present Contract, the guilty party shall be liable in accordance with the existing legislation of the Republic of Belarus as well as taking into account the specifications provided for in the present Contract.
- The Seller shall not be responsible:
- for any damages caused by the Buyer or Consignee in the result of his/her improper use of the goods purchased in the online-store;
- for the consequences caused by the Buyer’s or Consignee’s actions in case the goods purchased from the Seller have been used for entrepreneurial purposes;
- for the acts and omissions of the postal and delivery services Personnel.
- The Seller shall not be responsible for Buyer’s or Consignee’s losses occurred as the result of:
- misinformation at aligning the order including incorrect identification information:
- unlawful actions of third parties.
- The Buyer shall be responsible for the reliability of the information provided when making an order.
- The parties shall be exempted from the responsibility for complete or partial non-fulfilment of the obligations under the present Contract if it has been a consequence of action of a force-majeure occurred after the entry into force of the present Contract and/or in the result of extraordinary events that Parties have not been able to foresee or prevent.
- In other cases not provided for in article 7.5. of the present Contract, the Parties shall be liable for non-fulfilment or improper fulfilment of the obligations in accordance with the existing legislation of the Republic of Belarus.
- COPYRIGHT
- All text information and graphic images presented on the web-site shop.comeforta.by shall be regarded as intellectual property of the Seller/Producer.
